Pallet Rack Market LLC (“Pallet Rack Market,” “we,” “us,” or “our”) operates the website www.palletrackmarket.com and related applications, including our iOS app and our Android app (together, the “Services”).

This Privacy Policy explains how we collect, use, disclose, and retain personal information in connection with the Services. It applies to information we collect through the Services and through communications you send us about the Services. It does not apply to websites, apps, or practices of other companies, and it does not govern how other marketplace users handle information you give them directly.

Pallet Rack Market is an online platform designed to help users find listings and connect with one another about pallet rack, warehouse equipment, and related materials and services. We do not sell the materials shown in user listings. We do not buy those materials. We do not act as buyer, seller, broker, dealer, merchant of record, escrow agent, payment intermediary, shipper, or fulfillment provider for transactions in listed materials. Any purchase, sale, payment, inspection, pickup, delivery, shipping, warranty, return, or other deal involving listed materials is arranged independently by the users and occurs off the platform.

The only payments we collect for ourselves are fees for paid membership or account tiers and any related platform charges we expressly offer, such as paid visibility included in a subscription plan. We do not receive, process, transmit, hold, escrow, or otherwise handle payment for pallet rack or other materials advertised by users.

By using the Services, you acknowledge this Privacy Policy. If you do not agree with it, do not use the Services.

1. Information We Collect

We collect information you provide, information collected automatically when you use the Services, and information we receive from service providers that help us operate the Services.

Information you provide

Depending on how you use the Services, this may include:

  • Account information, such as name, business name, username, password, email address, phone number, mailing or business address, and profile details.
  • Listing information, such as item or service descriptions, specifications, condition, quantity, asking price or list price, availability, yard or location information, photographs, and other content you choose to include in a listing or “In Search Of” inquiry.
  • Inquiry and messaging information, such as questions, quote requests, and messages you send through the Services to us or to another user.
  • Subscription and billing information, such as the plan you select, billing contact details, and records of subscription charges, renewals, failures, refunds, and account status.
  • Support information, such as emails or other messages you send to us, and information needed to respond.
  • Business-verification information, if you request a paid tier or feature that includes verification, such as business name, address, and other details you submit for that purpose.

You decide what to put in a listing or profile. Do not include information in a public listing that you are not willing to make public.

Information collected automatically

When you visit or use the Services, we and our service providers may collect:

  • Device and technical information, such as IP address, browser type, device type, operating system, general location derived from IP address, referring URL, pages viewed, dates and times of access, and similar log data.
  • Usage information, such as searches, listings viewed, features used, and how you move through the Services.
  • Cookie and similar technology data, as described below.

Information from service providers

We may receive limited information from companies that help us host the Services, process subscription payments, send email, provide security or fraud prevention, or analyze site performance. For example, a payment processor may tell us whether a subscription payment succeeded.

We do not collect payment-card numbers for purchases of listed materials, because those purchases do not occur through Pallet Rack Market. For subscription fees, payment-card details are generally collected and processed by a third-party payment processor. We typically receive confirmation and billing-status information, not a full card number, unless a processor or billing tool makes limited card details available to us in the ordinary course of account administration.

2. Public Listings and User-to-User Contact

Some information on the Services is intended to be visible to other users and may be visible to the general public, including people who do not have an account and people who find a listing through search engines.

Public listing information commonly includes the listing title and description, photographs, specifications, quantity, price or list price, city and state or other location you provide, availability, and the listing user’s business name or other profile information the listing displays. If you include a phone number, email address, street address, or other personal details in a listing, that information may also become public.

Treat public listings as public. Do not place home addresses, personal mobile numbers, financial account numbers, or other sensitive personal information in a listing unless you intend that information to be widely available.

The Services include tools that let users contact one another, such as “Ask a Question,” “Request a Quote,” and “Message.” When you use those tools, we collect the content of the inquiry and related account information so we can deliver it to the intended user and operate the connection features of the platform.

After users connect, they may continue the conversation off the platform by email, telephone, text message, or other means they choose. Once you voluntarily give information directly to another user, that user may collect and use it independently. Pallet Rack Market does not control, and this Privacy Policy does not govern, another user’s independent privacy practices. We generally cannot retrieve, delete, or restrict information after you have given it to another user outside the Services.

Any resulting negotiation, purchase, payment, delivery, pickup, or other transaction is conducted by those users off the platform. Pallet Rack Market is not a party to that transaction and does not process payment for listed materials.

3. How We Use Information

We use personal information to:

  • Operate, maintain, and improve the Services, including accounts, listings, search, quotes, messaging, and paid membership tiers.
  • Create and administer your account and verify login credentials.
  • Display listings and profile information you choose to make public.
  • Route inquiries, quote requests, and messages between users who choose to connect.
  • Process subscription fees, manage plan upgrades and cancellations, send billing notices, and keep subscription records.
  • Provide customer support and respond to questions.
  • Communicate about your account, listings, inquiries, security, and Service changes.
  • Send service-related and, where permitted, promotional emails. You may unsubscribe from promotional emails using the link in those messages or by contacting us. We may still send non-promotional messages about your account or the Services.
  • Monitor for fraud, abuse, spam, security incidents, and violations of our terms.
  • Analyze how the Services are used so we can fix problems and improve features.
  • Comply with law, respond to lawful requests, and protect the rights, property, and safety of Pallet Rack Market, our users, and others.

We do not use information collected through the Services to complete checkout for listed materials, because the Services are not a checkout platform for those materials.

4. Cookies and Similar Technologies

We use cookies and similar technologies to operate the Services, keep you signed in, remember preferences, maintain security, and understand how the Services are used.

You can control cookies through your browser settings. If you block certain cookies, parts of the Services may not work properly, including account login.

Some browsers offer a “Do Not Track” setting. There is no uniform standard for responding to Do Not Track signals, and we do not currently treat those signals as an opt-out request. Where required by applicable law, we will honor a legally recognized opt-out preference signal, such as Global Privacy Control, as an opt-out of sale or sharing of personal information for targeted advertising. If we are not then selling or sharing personal information for those purposes, the signal simply confirms that opt-out. If we later begin those activities, the same signal will be treated as your opt-out to the extent the law requires.

We may use service providers that set their own cookies or collect technical information when they help us host, secure, analyze, or bill for the Services. We do not control those providers’ technologies.

5. How We Disclose Information

We do not currently sell personal information for money. We do not currently share personal information with third parties for their own cross-context behavioral advertising.

We may later sell personal information or share it for cross-context behavioral advertising or targeted advertising. If we do, we will update this Privacy Policy, describe the categories of information involved, and provide any required notice and opt-out, including a “Do Not Sell or Share My Personal Information” link or comparable control where the law requires one. You may also make an opt-out request using the contact information below. Where required, we will honor a legally recognized opt-out preference signal, such as Global Privacy Control.

We may disclose personal information as follows:

To other users, when that is the point of the feature. Information you place in a public listing is disclosed to other users and may be disclosed to the public. When you send an inquiry, quote request, or message through the Services, we disclose the content of that communication and related contact or account details to the intended recipient so the users can connect.

To service providers. We use vendors to host the Services, store data, process subscription payments, send email, provide analytics, prevent fraud, and give technical support. These providers are permitted to use personal information only to perform services for us or as required by law.

To a payment processor for subscription billing. If you buy a paid tier, your payment information is submitted to a third-party processor that handles the charge. That processor’s privacy policy governs its handling of payment-card data.

For legal and safety reasons. We may disclose information if we believe in good faith that disclosure is required by law or is reasonably necessary to respond to a legal process, investigate potential violations of our terms, or protect Pallet Rack Market, users, or the public.

In a business transfer. If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, personal information may be transferred as part of that transaction, subject to this Policy or a successor policy.

With your direction or consent. We may disclose information when you ask us to or when you otherwise consent.

We do not disclose payment information for material purchases through the Services, because those payments do not run through Pallet Rack Market.

Other users who receive information from you are not our service providers. Their use of that information is their responsibility.

6. Retention

We keep personal information only as long as reasonably needed for the purposes described in this Policy, including to maintain your account, display listings, provide connection features, administer subscriptions, keep tax and business records, resolve disputes, and meet legal obligations.

When we no longer need personal information for those purposes, we delete it or de-identify it, except to the extent we must retain it by law or for legitimate business records. We do not commit to a single fixed deletion date for every category of information, because retention depends on the type of data and the reason we hold it.

Information you published in a listing or sent to another user may remain visible to others, or remain in the other user’s records, after you change or delete it on the Services.

7. Security

We use administrative, technical, and physical safeguards that are commercially reasonable for a service of this type. No website, app, or transmission is completely secure. We cannot guarantee that unauthorized access, disclosure, alteration, or destruction will never occur. You are responsible for keeping your password confidential and for activity on your account.

8. Children’s Privacy

The Services are intended for business users and other adults. They are not directed to children. We do not knowingly collect personal information from anyone under 18. If you believe we have collected personal information from a person under 18, contact us and we will take appropriate steps to delete it.

9. Your Choices and Privacy Rights

You may review and update certain account information by logging into your account. You may also request that we correct information we maintain about you.

You may opt out of promotional emails by using the unsubscribe link in those emails or by contacting us. This does not apply to messages about your account, subscription, listings, or safety.

Depending on the state where you live, you may have the right to:

  • Request access to personal information we maintain about you.
  • Request a copy of certain personal information in a portable form.
  • Request correction of inaccurate personal information.
  • Request deletion of personal information, subject to legal and operational exceptions.
  • Opt out of the sale of personal information, the sharing of personal information for cross-context behavioral advertising, or targeted advertising, if we engage in those activities.
  • Appeal our decision on a request, where state law provides an appeal.

If you are a California resident, additional information is in Section 12.

We will not deny goods or services, charge a different price, or provide a different level of service because you exercised a privacy right, except as permitted by law.

To make a request, email info@palletrackmarket.com or write to the address below. We may need to verify your identity before completing the request. You may use an authorized agent where the law allows it, and we may require proof of the agent’s authority.

Some information cannot be deleted in full, including information we must keep for legal, security, or accounting reasons, information that is part of another user’s communication records, and information you already made public in a listing.

If we deny a request and applicable law gives you a right to appeal, you may appeal by emailing info@palletrackmarket.com with the subject line “Privacy Request Appeal.”

10. International Visitors

We are based in the United States and operate the Services from the United States. If you access the Services from another country, your information will be processed in the United States, which may have different data-protection rules from your country.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the revised Policy on this page and update the “Last Updated” date. If we make a change that materially affects how we use personal information, we will provide additional notice when reasonably practicable, such as a notice on the Services or an email to the address on your account. The revised Policy applies to information we already have and information we collect after the effective date, except where applicable law requires otherwise.

12. California Privacy Rights

This section applies to California residents and supplements the rest of this Privacy Policy. It is provided to meet California’s consumer privacy laws, including the California Consumer Privacy Act as amended by the California Privacy Rights Act.

Notice at collection

We collect the following categories of personal information. We collect it from you, automatically when you use the Services, and from service providers that help us operate accounts, hosting, security, email, analytics, and subscription billing.

Identifiers. Yes. Examples: name, business name, postal address, email address, phone number, account name, and IP address.

Customer records information. Yes. Examples: name, business or mailing address, telephone number, and billing contact details.

Protected classification characteristics. No. We do not collect race, religion, sexual orientation, or similar characteristics.

Commercial information. Yes. Examples: subscription plan and billing status, listing activity, and inquiries sent through the Services.

Biometric information. No. We do not collect fingerprints, faceprints, or voiceprints used to identify you.

Internet or network activity. Yes. Examples: pages viewed, searches, listing views, log data, and cookie data.

Geolocation data. Yes. We may collect approximate location derived from IP address.

Precise geolocation. No. We do not collect exact GPS or similar precise location.

Sensory information. Yes. Examples: photographs or other images you upload to a listing or send through the Services.

Professional or employment information. Yes. Examples: business affiliation and related profile details you provide.

Education information. No. We do not collect non-public student records.

Inferences used to build a consumer profile. No. We do not build personality, preference, or similar consumer profiles.

Sensitive personal information. Limited. We collect the account password used to log in. We do not collect Social Security numbers, driver’s license numbers, precise geolocation, or financial account numbers with access codes, and we do not use sensitive personal information to infer characteristics about you.

We do not collect payment-card numbers for purchases of listed materials. Those purchases do not occur through Pallet Rack Market. For subscription fees, a third-party payment processor generally collects payment-card details. We typically receive confirmation and billing-status information, not a full card number.

We use this information for the purposes described in Section 3, including to operate the Services, administer accounts and subscriptions, display listings you choose to make public, route user-to-user inquiries, provide support, maintain security, and comply with law.

We keep personal information only as long as reasonably needed for those purposes, including account administration, security, tax and business records, dispute resolution, and legal compliance. We do not use a single fixed retention period for every category.

We do not currently sell personal information for money. We do not currently share personal information for cross-context behavioral advertising. We have not sold personal information for money or shared it for cross-context behavioral advertising in the preceding 12 months. If that changes, we will update this Policy and provide any required notice and opt-out, as described in Section 5.

Sensitive personal information

We use account passwords only to operate and secure your account. We do not use sensitive personal information to infer characteristics about you, and we do not use it for purposes that require a “Limit the Use of My Sensitive Personal Information” link.

Automated decision-making

We do not use automated decision-making technology to make significant decisions about you, such as decisions concerning financial or lending services, housing, education enrollment, employment, or healthcare.

Your California rights

California residents may request to:

  • Know the categories and specific pieces of personal information we have collected about you, the categories of sources, the business or commercial purposes for collection, and the categories of third parties to whom we disclose it.
  • Access a copy of personal information we maintain about you.
  • Correct inaccurate personal information.
  • Delete personal information, subject to legal and operational exceptions.
  • Opt out of sale or sharing of personal information if we engage in sale or sharing.
  • Limit the use and disclosure of sensitive personal information, if we use it for purposes that give rise to that right.
  • Not be denied goods or services, charged a different price, or provided a different level of service for exercising these rights, except as permitted by law.

How to submit a request

Only you, or someone you authorize to act for you, may submit a request. We may need to verify your identity. If you use an authorized agent, we may require proof of the agent’s authority.

We will confirm receipt within 10 business days and respond within 45 calendar days. If we need more time, we will tell you.

If we deny a request and you have a right to appeal, email info@palletrackmarket.com with the subject line “Privacy Request Appeal.”

California “Shine the Light”

California Civil Code section 1798.83 permits California residents to request information about personal information disclosed to third parties for their own direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes.
